Terms of Service

1. Acceptance and Eligibility

These Terms of Service (“Terms”) form a binding agreement between you and the Florida AI Council (“Council,” “we,” “us,” or “our”) concerning your use of flaicouncil.org and any related services we make available through it (collectively, the “Service”).

You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian. The Service is not directed to children under 13.

2. Accounts and Account Security

Certain features require an account. You agree to provide accurate information, keep it reasonably current, protect your sign-in credentials, and promptly notify us if you believe your account has been accessed without authorization.

You are responsible for activity conducted through your account. Accounts are personal and may not be sold, transferred, shared, or used to impersonate another person or organization. We may require email verification or other reasonable steps to protect account integrity.

3. Community Standards

The forum exists for constructive discussion. You may not use the Service to:

  • harass, threaten, abuse, defame, or unlawfully discriminate;
  • post unlawful, fraudulent, deceptive, or infringing material;
  • publish another person’s private or confidential information;
  • send spam, solicitations, malware, or disruptive automated traffic;
  • circumvent access controls or enter restricted areas without authorization;
  • interfere with the security, integrity, or operation of the Service; or
  • encourage or assist another person in violating these Terms.

Topic-specific rules and reasonable administrator instructions are incorporated into these Terms. Some areas may be limited to administrators, Founder’s Club members, or other designated groups.

4. Your Content

You retain ownership of original material you submit, including forum posts, replies, profile information, and images (“User Content”). You represent that you have the rights needed to submit that content and that doing so does not violate law or the rights of another person.

By submitting User Content, you grant the Council a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content solely as reasonably necessary to operate, secure, improve, and promote the Service. This license ends when the content is deleted from our active systems, except for reasonable backup, legal, security, or archival retention.

Forum posts are intended for public or community viewing. Do not post information that you want to remain private.

5. Moderation, Suspension, and Termination

We may review, flag, restrict, edit, move, or remove content, and may warn, suspend, or terminate accounts, when we reasonably believe action is necessary to enforce these Terms, protect the community, comply with law, or maintain the Service. We are not obligated to monitor every submission and do not endorse user statements merely because they appear on the Service.

You may stop using the Service at any time. Account deletion requests may be made through available account controls or the Contact form. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and indemnity—will survive.

6. Council Content and Intellectual Property

The Service and its Council-created text, graphics, branding, layouts, software, and other materials are owned by or licensed to the Council and are protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service.

You may link to publicly available pages in a lawful manner that does not imply sponsorship or endorsement. Names, logos, and marks belonging to others remain the property of their respective owners.

7. Information, Third-Party Services, and Disclaimers

Council articles, forum discussions, assessments, calculators, event materials, and other resources are provided for general educational and informational purposes. They are not legal, financial, investment, employment, cybersecurity, or other professional advice, and no professional or fiduciary relationship is created by your use of the Service.

The Service may link to or rely on third-party services. We do not control and are not responsible for third-party content, availability, security, or practices. Your use of third-party services may be governed by separate terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPLETELY ACCURATE.

8. Limitation of Liability and Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COUNCIL AND ITS DIRECTORS, OFFICERS, MEMBERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE.

You agree to defend, indemnify, and hold harmless the Council and the foregoing persons from claims, liabilities, damages, losses, and reasonable expenses arising from your User Content, misuse of the Service, or material violation of these Terms or another person’s rights. Nothing in these Terms excludes liability that cannot lawfully be excluded.

9. Changes, Governing Law, and Contact

We may modify the Service or these Terms as the Service evolves. Material changes will be identified by a revised effective date and, when appropriate, additional notice. Continued use after a change takes effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any proceeding arising from these Terms will be brought in a court of competent jurisdiction located in the county of the Council’s principal Florida office, unless applicable law requires otherwise.

If any provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. These Terms and the Privacy Policy constitute the entire agreement concerning the Service.
